Terms of Service
Last updated October 11, 2026
These terms apply when you buy a website care plan or a one-time project from Peninsula Web Care, run by Steve Kriz and based on the SF Peninsula ("I" or "me"). The short version: I look after your website for a flat price, you keep ownership of everything, and you can cancel anytime. If we've signed a separate written agreement, that agreement wins where the two differ.
1. What you get
- Monthly plans cover routine care of one website: updates, backups, security and uptime monitoring, the changes included in your plan, and a monthly summary, as described on the plans section when you sign up. Unused changes don't roll over.
- One-time projects have a fixed price and a result we agree on by email before I start.
- Not included unless we agree in writing: redesigns or new features, problems caused by your host or other developers, copywriting beyond small edits, paid tools, and other websites. If you ask for something extra, I'll tell you the price first and only start once you say yes.
- I work on business days (Monday to Friday, except holidays) and usually reply the same or next business day.
2. Payment
- Payments are processed securely by Stripe. I never see or store your full card or bank details.
- Plans are charged in advance, monthly or yearly, starting the day you sign up.
- Projects are paid up front. New websites can instead be paid 50% before work starts and 50% at launch.
- Plan members get 15% off one-time projects while their plan is active.
- Prices don't include third-party costs such as hosting, domains or paid plugins, which you pay directly unless we agree otherwise.
- I'll give you at least 30 days' email notice before changing your plan price.
- If a payment fails and isn't fixed within 7 days of my reminder, I may pause work until it is. If a charge ever looks wrong, please email me first so I can fix it quickly.
3. Renewal and cancellation
- Plans renew automatically each month (or each year, for annual plans) until you cancel. I'll email you a reminder at least 15 days before an annual plan renews.
- Cancel anytime, online through the billing link in your receipts or by emailing [email protected]. There are no contracts or cancellation fees.
- Cancellation takes effect at the end of the period you've paid for, and your plan keeps working until then. I don't refund partial months or years.
- When your plan ends, I'll remove my access and send you your latest backup if you ask within 30 days.
4. Refunds for projects
- If I can't deliver a project as agreed, I'll refund what you paid for the part not delivered.
- For an Emergency fix, if I can't get your site working again, you get a full refund.
- If you cancel a project after I've started, you pay for the work done so far.
5. Your part
- Give me the access I need, ideally a separate login rather than your own password.
- Make sure the content you send (text, photos, logos, prices) is accurate and that you have the right to use it.
- Keep your hosting, domain and other accounts in your own name and paid up.
- Reply to questions in reasonable time. Delays on your side can delay the work.
6. Ownership and confidentiality
- You own your website, content, domain and accounts. Once a project is paid for, you own the work I made for it.
- I keep your business information and logins confidential, store logins in an encrypted password manager, and use them only to do the work. See the privacy page for how this website handles information.
- I may use trusted tools (such as backup, monitoring and AI-assisted software) to do the work, under the same confidentiality.
- I won't name you as a client or show your site in my marketing without your permission.
7. What I can and can't promise
- I do the work with reasonable skill and care. No one can guarantee a website will never go down or be hacked, and I can't guarantee uptime, search rankings, traffic or sales.
- If something breaks, I'll restore a recent backup and work to fix the cause as part of your plan. A major clean-up after a serious hack may be quoted as a project.
- I'm not responsible for outages or changes by hosting companies, plugin makers or other third parties.
- As far as the law allows, my total liability for any claim is limited to what you paid me in the 3 months before the claim, or the price of the project the claim is about, whichever is greater. Neither of us is liable for indirect losses such as lost profits. These limits don't apply to fraud or anything the law doesn't allow to be limited.
8. The rest
- California law applies. We'll try to sort out any disagreement by talking first. If that doesn't work, either of us can use small claims court in San Mateo County.
- I'm an independent contractor, not your employee.
- If I update these terms, I'll change the date at the top and email current plan members about any important change.
- If any part of these terms can't be enforced, the rest still applies.
